Terms of Service

Welcome to RioProgress, a 501(c)(3) non-profit organization based in Brownsville, Texas. By using our website and services, you agree to comply with these terms of service (the "Agreement") and our Privacy Policy. Please read them carefully before using our website or services.

1. Acceptance of Terms

By accessing or using RioProgress, you agree to be bound by these Terms of Service, which may be updated from time to time. We reserve the right to modify or terminate any part of the services we provide or this Agreement at any time and without prior notice.

2. Non-Profit Status

RioProgress is a non-profit organization registered under the laws of the State of Texas. All donations made to our organization are tax-deductible to the extent allowed by law.

3. Use of Services

You may use RioProgress services only for lawful purposes and in accordance with these Terms of Service. You agree not to use our services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To engage in any activity that interferes with or disrupts our services.
  • To gain unauthorized access to any part of our services, or any other system or network.
  • To impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • To upload, post, or otherwise transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

4. Donations and Subscriptions

RioProgress relies on the generosity of donors to carry out its mission. By donating or subscribing, you agree that:

  • You are at least 18 years of age.
  • Your donation or subscription payment is made voluntarily and is not a payment for goods or services.
  • A subscription constitutes a recurring monthly donation that will be charged automatically to your designated payment method until you update or cancel.
  • You may cancel your recurring donation at any time by contacting us or using the tools provided on our website. Cancellations will apply to future charges only.
  • Refunds: Donations are non-refundable. However, if a payment error occurs, please contact us and we will work with you to resolve the issue.
  • RioProgress may use your donation for any purpose consistent with our mission, as determined by our Board of Directors.
  • You will receive a receipt for each donation, and an annual summary may be provided for tax purposes.
  • Donations to RioProgress are tax-deductible to the extent allowed by law.

5. Intellectual Property

RioProgress retains all rights, title, and interest in and to our website and services, including all intellectual property rights. You may not use any of our trademarks, logos, or other proprietary information without our prior written consent.

6. Disclaimers

Our services are provided "as is" and "as available." RioProgress makes no representations or warranties of any kind, express or implied, as to the operation of our services or the information, content, materials, or products included in our services. To the fullest extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

RioProgress will not be liable for any damages of any kind arising from the use of our services, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

8. Indemnification

You agree to indemnify and hold RioProgress, its directors, officers, employees, and agents, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of our services, your violation of these Terms of Service, or your violation of any rights of another.

9. Governing Law

This Agreement and any dispute arising from or relating to it will be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of law.

10. Entire Agreement

This Agreement constitutes the entire agreement between you and RioProgress with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
